Terms of Service

Please read these terms carefully. By engaging Capstone Enterprises for snow removal and ice management services, you agree to the following terms and conditions regarding liability, payments, and service execution.

1. Acceptance of Terms

By accessing the Capstone Enterprises website, requesting a quote, or hiring us for snow removal and ice management services, you agree to be bound by these Terms of Service. These terms apply to all residential, commercial, and HOA clients. If you do not agree with any part of these terms, you must not use our services. We reserve the right to update these terms at any time without prior notice.

2. Service Scope and Weather Conditions

Our services are performed based on the specific scope outlined in your service agreement or quote. While we strive for timeliness, the precise timing of service cannot be guaranteed due to the unpredictable nature of winter weather, road conditions, and storm severity. Capstone Enterprises reserves the right to delay services in the event of severe blizzard conditions, road closures, or safety hazards that pose a risk to our crew or equipment.

3. Pricing, Estimates, and Billing

All estimates provided online or over the phone are preliminary and subject to site inspection. Final pricing is determined by the actual square footage, terrain difficulty, and accumulation depth. For contract clients, payments are due as specified in the agreement (e.g., monthly seasonal rates). For per-push or on-demand services, payment is due upon receipt of the invoice. Past due accounts may be subject to a late fee of 1.5% per month or the maximum amount allowed by law.

4. Property Access and Obstructions

The Client is responsible for ensuring that the service area (driveways, walkways, loading docks) is free of obstacles such as parked vehicles, toys, trash cans, or extension cords. Capstone Enterprises is not responsible for unserviced areas due to obstructions. If our crew arrives and cannot perform the service due to blocked access, a trip charge or the full service fee may still apply.

5. Limitation of Liability for Property Damage

Snow removal involves the use of heavy machinery and sharp implements. While we exercise reasonable care, Capstone Enterprises is not liable for minor scrapes, scratches, or rust marks on pavement, concrete, or pavers, which are considered normal wear and tear of snow plowing. We are not responsible for damage to landscaping, sprinkler heads, retaining walls, or other objects that are hidden under snow and not clearly marked with high-visibility stakes by the Client prior to the season.

6. Ice Management and Slip-and-Fall Disclaimer

Ice management services (salting, sanding, brine) are intended to reduce, but cannot completely eliminate, the risk of slipping. Weather conditions such as freeze-thaw cycles can cause ice to reform rapidly after we have serviced the property. The Client acknowledges that walking surfaces may remain slippery even after treatment. Capstone Enterprises assumes no liability for slip-and-fall accidents or injuries resulting from naturally occurring ice or snow conditions.

7. Cancellation and Termination

Clients may cancel a scheduled one-time service with at least 24 hours' notice. Cancellations made within 24 hours of the scheduled service window may incur a cancellation fee. Seasonal contracts may be terminated by either party with written notice as specified in the individual service agreement. In the event of termination, the Client is responsible for payment of all services rendered up to the date of termination.

8. Governing Law

These Terms of Service and any disputes arising out of or related to the services provided by Capstone Enterprises shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
